Antes de presentar tu solicitud en línea, es crucial verificar la clasificación de tus productos o servicios y asegurarte que la marca que deseas registrar sea distintiva y no infrinja ninguna causal de irregistrabilidad.
We submit the application to INAPI
Una vez recibido el visto bueno por tu parte, procedemos a realizar la solicitud de registro ante INAPI. En este punto se debe pagar 1 UTM en el portal de INAPI. Este pago lo puedes hacer tú o nosotros.
Formal Examination
Una vez presentada la solicitud, esta será revisada para detectar posibles errores u omisiones. Si está todo correcto, se aceptará a tramitación. En caso de observaciones, tendremos 30 días para aclararlas, o de lo contrario, la solicitud se declarará abandonada.
Publication in the Official Gazette
After acceptance for processing, we must publish an excerpt of the application in the Official Gazette. This has a cost, and the price depends on the length of the excerpt.
Substantive Examination
After 30 business days from publication, the application is submitted to a substantive examination by the Director of INAPI. If there are no grounds for unregistrability, the application is accepted for registration.
Payment for application accepted for registration
We have 60 business days to make the final payment. If objections or observations arise, you must proceed according to the regulations, which may include appeals and a team of lawyers.
Obtain the ownership certificate
Once the final payment is made, we will obtain the trademark ownership certificate, which will grant protection for a period of 10 years.

What is the process to register a trademark?
Application Filing: Antes de presentar tu solicitud en línea, es crucial verificar la clasificación de tus productos o servicios y asegurarte de que la marca que deseas registrar sea distintiva y no infrinja ninguna causal de irregistrabilidad.
Formal Examination: Una vez presentada la solicitud, esta será revisada para detectar posibles errores u omisiones. Si está todo correcto, se aceptará a tramitación y se notificará en el estado diario. En caso de observaciones, tendrás 30 días para aclararlas, o de lo contrario, la solicitud se declarará abandonada.
Publication: Tras la aceptación a tramitación, debes publicar un extracto de la solicitud en el Diario Oficial, lo que puedes hacer en línea o en las oficinas del Diario. Este paso debe completarse dentro de los 20 días hábiles siguientes a la aceptación. Después de la publicación, hay un período de espera de 30 días hábiles para posibles oposiciones.
Substantive Examination: Pasados los 30 días hábiles de la publicación, la solicitud se somete a un examen de fondo por el Director del INAPI. Si no hay causales de irregistrabilidad, la solicitud se acepta para registro, y tienes 60 días hábiles para realizar el pago final. Si surgen oposiciones o observaciones, se debe proceder de acuerdo con las normativas, lo que puede incluir apelaciones y la representación por un abogado.
How long will it take to obtain my registered trademark?
El tiempo para obtener una marca registrada varía, pero generalmente, en Chile, el proceso puede durar entre 6 a 8 meses, siempre que no haya complicaciones o retrasos, como observaciones u oposiciones.

How much does it cost to register a commercial trademark in Chile?
Registering a trademark in Chile involves two payment stages: an initial one when submitting the application and another at the end of the process.
The initial cost is 1 Unidad Tributaria Mensual (UTM) and the final cost is 2 UTM for each class of product or service you register, totaling 3 UTM.
In addition, the law requires publishing an excerpt of the application in the Diario Oficial, whose cost varies according to the description of your products or services.
If the final payment is not made within 60 business days after the acceptance notification, the application is considered abandoned.
